Accident Waiver and Release of Liability Form
I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING AND/OR VOLUNTEERING IN ANY AND ALL ACTIVITIES OR EVENTS (INCLUDING AND NOT LIMITED TO ANY AND ALL FITNESS CLASSES OR PERSONAL TRAINING) HELD BY Inspiration Fitness LLC, including by way of example and not limitation, any risks equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.
I certify that I am physically fit, have sufficiently prepared or trained for participation in the activity or event, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this activity or event.
I acknowledge that this Accident Waiver and Release of Liability Form will be used by Inspiration Fitness LLC for the activity or event in which I may participate, and that it will govern my actions and responsibilities at said activity or event, or continued activities or events.
In consideration of my application and permitting me to participate in this event or activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the fault of the entities or persons releases, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this event or activity, THE FOLLOWING ENTITIES OR PERSONS: Inspiration Fitness LLC and/or their directors, officers, employees, volunteers, representatives, and agents, the activity or event holders, activity or event sponsors, activity or event volunteers;
(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity or event, whether caused by the negligence of release or otherwise. I acknowledge that Inspiration Fitness LLC and their directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific event or activity on behalf of Inspiration Fitness LLC.
I acknowledge that this activity or event may involve a test of a person's physical and mental limits and may carry with it the potential for death, serious injury, and property loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, event officials, and event monitors, and/or producers of the event, and lack of hydration. These risks are not only inherent to participants, but are also present for volunteers.
I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity or event.
The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
New Client Agreement
This agreement is made and entered into this day (hereafter referred to as “client”) and Inspiration Fitness LLC. in consideration of the
mutual promises exchanged herein and other good and valuable consideration, the parties agree as follows:
1. Client and Inspiration Fitness LLC agree that a certified personal trainer and certified group exercise instructor will conduct the training session(s) or class(es) at a mutually convenient, agreed upon time to be scheduled in accordance with the trainer’s and client’s availability and schedule. The training session(s) and/or class(es) will be scheduled and paid for prior to the participation in them.
2. Client acknowledges and agrees that no credit or refund shall be due for training session(s) cancelled by the client unless at least 24-hour notice is given of cancellation or rescheduling a session or for documented
medical reasons by a licensed medical professional, denoted in writing.
3. Client acknowledges and agrees that if at least 8-hour notice is not given for cancellation of a class
reservation, client will be charged the full class fee.
4. All training sessions or classes will not exceed 55 minutes in length and will begin at the scheduled time. If a client is late, that time will be deducted from the session or class. If a client is more than 20 minutes late for a session or class, it will be forfeited and a credit or refund will not be given.
5. All sessions and/or classes must be completed within the time specified by Inspiration Fitness LLC at the time of purchase or the session(s) and/or class(es) package amount is forfeited.
Assumption of Risk and Waiver
I have volunteered to participate in a program of physical exercise under the direction of a
certified trainer with Inspiration Fitness LLC. This activity will include, but may not be limited to, weight and/or resistance training and/or fitness classes. In consideration of Inspiration Fitness LLC’s agreement to instruct, assist, and/or suggest individual exercise(s) and/or nutrition information for me, I do here and forever release, discharge, and hold harmless Inspiration Fitness LLC and its officers and employees harmless and any of their respective agents, heirs, assigns, and contractors from any and all injuries, claims, demands, damages, rights of action, present or future arising out of or connected with my participation in this or any exercise program. I release Inspiration Fitness LLC, its owners, operators, agents, employees, contractors, agents, heirs, assigns, etc. of any and all liability. I understand and acknowledge that any exercise can and may be difficult and/or strenuous. I also understand that I should seek my physician’s advice prior to beginning any
exercise program.
Cancellation Policy
The undersigned parties do therefore agree to all above mentioned phrases and clauses. It is also understood that 24-HOUR NOTICE must be given to reschedule or cancel my participation in a PERSONAL training session or I forfeit that session. It is also understood that a 8-HOUR NOTICE must be given to cancel my reservation for a class or I will be charged the full class fee.
